Capitalized terms used but not defined in this Policy have the meanings given to them in the TruckDown Terms of Use Agreement.
TruckDown Info International, Inc. (“TruckDown”) utilizes a Vendor Rating system, which allows Users to rate the service that they receive from a Vendor, in accordance with a Policy developed by TruckDown specifically for this purpose. Ratings are User driven, and TruckDown believes that both Users and Vendors will benefit from this system. Users use these ratings to make informed decisions on which vendor to call, and vendors use these ratings to gather feedback and engage with customers. For these reviews to deliver value, ratings must be an accurate reflection of true customer feedback. The premise for the Vendor Rating Policy is that a Rating and corresponding Feedback by a User are to relate to a specific service provided by a Vendor to that User.
The premise for the Vendor Rating Policy is that a Rating and corresponding Feedback by a User are to relate to a specific service provided by a Vendor to that User.
TruckDown will share a Rating with the Vendor being rated along with User contact information including name, phone number, and email address. This helps to provide feedback directly to the vendor listing owner or manager.
In addition, and as described further in item 5 below, TruckDown intends to publicly post each Rating and its associated Feedback — together with the User’s name and company name — and to allow the rated Vendor to publicly reply to that Rating, as described further in item 6 below. Posted Ratings and Feedback will be subject to TruckDown's review and approval in accordance with the requirements described in this policy.
The following outlines TruckDown’s Policy with respect to Vendor Ratings:
- A “Rating” consists of a 0.5 to 5 Rating scale (with 0.5 being the lowest and 5 being the highest), and must include User Feedback related to a specific transaction between a Vendor and a User.
- Only Users with an active TruckDown account (i.e. a registered User) can provide Ratings. Users must be logged in to provide Ratings.
- TruckDown reserves the right to screen all Ratings, as well as supporting Feedback, as part of our quality assurance processes.
- Ratings and their supporting Feedback is sent directly to the Vendor and/or the Vendor authorized recipients by email after any pre-screening performed by TruckDown (subject to item 3). Rating submissions to Vendors will include the User’s name, company name, telephone number and email address.
- Public Posting of Ratings. It is TruckDown's intent, subject to compliance with this Policy, to publicly display or publish a Rating and its associated Feedback on the TruckDown website, mobile applications, or other TruckDown platforms, together with the User’s name and the User’s company name (i.e., the employer of the User, or the company on whose behalf the Rating was submitted). By submitting a Rating, a User acknowledges and expressly consents to this potential public disclosure of the Rating, the Feedback, the User’s name, and the User’s company name. Any User who does not wish to have their identity disclosed should not submit a Rating.TruckDown is under no obligation to publicly post any particular Rating or Feedback, and may decline to publish, or may remove from public display, any Rating or Feedback at its sole discretion and at any time, including where a Rating is removed pursuant to item 15 below.
- Vendor Public Replies. Where a Rating and its associated Feedback are publicly posted under item 5, the Vendor that is the subject of that Rating may submit a reply for public posting alongside that Rating. A Vendor reply must relate directly to the specific transaction referenced in the Rating and is subject to the same content standards described in item 15 below, including (without limitation) the prohibitions on inappropriate language, inappropriate sexual references, racial slurs, scripts or links, and references to a different User’s incident or experience. A Vendor may not use a public reply to disclose a User’s personal contact information, or to solicit, harass, or retaliate against a User. TruckDown reserves the right to screen, decline to post, or remove any Vendor reply at its sole discretion and at any time.
- Except where a Rating and its associated Feedback are made public by TruckDown under item 5 (together with any Vendor reply posted under item 6), Rating Feedback is only visible online to the User who provided that Feedback and the Vendor who is the subject of that Feedback.
- Premium Vendor Review Period. Premium Vendors may receive 7 calendar days from when a Rating is submitted to review it and post a reply (item 7) before it goes public (item 6). During that window the Rating is shared privately as usual (item 4). Non-Premium Vendor listings have no waiting period — Ratings are posted publicly right away.
- Quality Rating Scores are calculated and assigned by TruckDown to Vendor listings based on cumulative Ratings provided by registered Users. Quality Rating Scores ARE visible to ALL Users as part of the listing display.
- Vendor listings with positive Quality Rating Scores may become eligible for TruckDown Preferred status. TruckDown Preferred status is calculated by TruckDown based on all Ratings provided by registered Users and is indicated by a display feature added to the listing.
- TruckDown does NOT endorse any Vendor, either through its Quality Rating Scores or through its TruckDown Preferred status, or through the public posting of any Rating, Feedback, or Vendor reply. The Scores and status are calculated based on User provided Ratings and as such are subject to change without notice.
- Users found to be abusing their accounts through inappropriate use of the Rating system may have their account access terminated by TruckDown.
- Vendors that attempt to improve their Quality Rating Scores through false or contrived Ratings, or that misuse the public reply feature described in item 6, may have their listings removed by TruckDown.
- Users can only assign one Rating per Vendor listing, but Users may change the Rating and associated Feedback as often as they choose to. Any public posting of the Rating and Feedback under item 5 will be updated to reflect the User’s most current Rating and Feedback.
-
TruckDown strongly encourages Vendors to deal directly with their customers with respect to Ratings and related incidents. In the event a Vendor disputes a Rating and wants TruckDown to remove that Rating (including removal from public display), there is a dispute form that can be completed online and submitted to TruckDown for review. TruckDown may remove a Rating, and any associated public posting or Vendor reply, if one or more of the following conditions exist:
- No supporting Feedback was provided with the Rating.
- Inappropriate language (ie: swearing).
- Inappropriate sexual references.
- Racial slurs.
- Ratings assigned in cases where no actual transaction between the User and the Vendor took place within the past 12 months, unless TruckDown is made aware of other information that explains why this is the case and is satisfied that, in such circumstances, the Rating should not be removed.
- Vendor self rates its listing(s) or rates other Vendor listings.
- Rating Feedback includes a script or link of any kind.
- Rating Feedback refers to a previous incident or experience of a different User.
- Rating Feedback includes political or religious comments not related to a specific transaction.
- User that provided the Rating cannot be contacted.
- User account that the Rating originates from contains invalid, missing or misleading contact information.
- Vendor sells business and is no longer involved in business in any way.
- Rating has been falsified or contrived in any manner whatsoever.
- Rating is older than two (2) years.
- The Rating, Feedback, or an associated Vendor reply otherwise violates the standards set out in this Policy, including the standards applicable to Vendor replies under item 6.
- Notwithstanding item 15, TruckDown reserves the right to remove, or to remove from public display, any Rating, Feedback, or Vendor reply at any time if TruckDown in its sole discretion considers such removal to be appropriate.
- Disclaimer. All Ratings, Feedback, and Vendor replies represent the views and opinions of the Users who submitted them, not of TruckDown. TruckDown does not adopt, endorse, or verify any such content. Any reliance on Ratings, Feedback, Quality Rating Scores, TruckDown Preferred status, or Vendor replies is at the User's own risk. For further disclaimers and limitations of liability, please refer to the TruckDown Terms of Use Agreement.
